TLC ordered by court: Stop using Cake Boss title

Last Friday, July 16th – TLC was ordered by a judge to stop using the “Cake Boss” title for their hit cable reality show featuring Hoboken’s own Carlo’s City Hall Bake Shop.

In a suit flied by Masters Software, a company that sells a software program by the same name that helps bakeries – The judge ruled that, while the company may actually be currently benefiting from the success of the TV show, “Masters is likely to prove that it has lost control of its product identity, its goodwill, and its ability to move into new markets” and that could change “Imagine, hypothetically, that one of Mr. Valastro’s cakes made a customer ill (like today for instance). This would no doubt receive much publicity. In that case, Masters’ forced association with Masters might be like a set of lead galoshes, rather than a hot-air balloon. But whether Cake Boss is perceived favorably or with disdain, Masters has no way to stop users from associating its CakeBoss brand with Cake Boss. This is irreparable harm to Masters.”

Not sure what the new name of the show would be! Cake Buddy? Cake Mafia? Cake mid-level manager?
