Hoboken Tree Fine Bludgeoning


Some “Tree City” Hoboken is! They plant trees in front of your building, but when the thing grows out of control – YOU have to pay for it! Here’s what one irate Hoboken resident has to say about yet another sham to steal your money to cover up city mismanagment:

Hoboken stealing from residents – it must be stopped!

Hoboken411 reader Chris sent this email in last week:

“Did you know the city is not responsible for the trees they planted? These photos represent a lawsuit being filed by a subject who says he was injured because of this sidewalk. Looks like every other sidewalk in Hoboken, yet my specific building is being targeted! Costs keep adding up in this town – it must be stopped!”

And he added a follow-up email yesterday – further adding salt to the wound:

“The CITY is demanding our condo pay over $2,200 to fix sidewalk which has been damaged due to the Tree Hoboken planted.
Hoboken will not let us remove the tree though! This is a serious issue after looking at many uplifted sidewalks throughout Hoboken.

What are our High Taxes going towards?”

If this process wouldn’t frustrate you – then you need serious help.

This is an issue across the country. Bloomberg is doing a plan in NYC for 1 million trees to be planted and (some) homeowners don’t like it either:

Sidewalks belong to the buildings, not the city. Planting of trees is something that the majority of residents are for & Chris has a valid gripe here because he’s paying for the fixing of his sidewalk.

But the problem is that unless the laws are changed nothing will happen. Chris & his homeowners association will be responsible, and if you google “trees city plant responsibility sidewalk” you can read plenty of other examples in other cities about outraged people over sidewalk repairs.

From what my friend’s father went through the city would only be responsible if someone had reported to them that there was city tree causing a problem with the sidewalk BEFORE anyone was hurt.

So the home owner would have to seen the sidewalk problem, thought, ‘gee I should get that taken care of, but I need a permit to work on the sidewalk and its the city’s tree. I’ll call the city and make them aware…’

So can anyone prove the city knew about the sidewalk?

Yup, that’s it. It is a scam, here’s how it works:

The city plants a tree. 15 years go by and the tree grows breaking up the sidewalk and then *blammo*, the trap is sprung! You are onto those nefarious tree tricksters!

Sounds like you are trying to practice your defense from a ‘slip and fall’ case. Your sidewalk must be kept in safe condition, if not you are liable. There are costs associated with being a home/condo owner…if you do not like those costs maybe you should be a renter.
