Hoboken Legal Beagle – 4/22/2008

A simple question today about incomplete parking tickets.

“What is the exact law regarding how a ticket is filled out in NJ? I received one recently that upon closer inspection the location box, where it should say (front of 505 Washington) merely just said ‘Washington’. Is this laziness on the part of the writing officer enough to get the ticket tossed out?”

I would love to just say YES, but nothing is absolute, is there a meter number indicated, does the original ticket have markings that did not go through, a ticket missing the officer signature would get the ticket thrown out but missing a street number might not, but here is an interesting site for those people who get NY parking tickets, I will be using it myself.

7:24. Defective Warrant or Summons; Amendment
No person arrested under a warrant or appearing in response to a summons shall be discharged from custody or dismissed because of any technical insufficiency or irregularity in the warrant or summons, but the warrant or summons may be amended to remedy any such technical defect.

This laziness is standard operating procedure for the Parking Authority.
Beagle be damned, experience tells me FIGHT THAT TICKET! I’ve received all sorts of interesting tickets in our fair city. I’ve fought all of them and WON! Incomplete tickets are definitely worthy of a fight. The problem in this town is that nobody wants to take the time to fight the ticket. Most find that it is worth the $20 (overtime meter parking violation) to not have to go to court or make some calls or do anything at all. If nobody fights bogus tickets then there is no incentive for the Parking Enforcement Officers to “get it right.” Frankly I have recieved tickets that defy explanation. One was for a Meter Violation at “00 Willow Ave.” No such address and no meters on that street….DISMISSED! One was for a hydrant at 86 Park Ave. No hydrant at 86 Park……DISMISSED! The only way to keep the Parking Authority in check is to FIGHT, FIGHT, FIGHT! So take that ticket to court and keep your money in your pocket!

So no insulting tirade about entitlement this week that makes wild assumptions about the writer? No defense of those with political connections getting better treatment than the little people? Just answering the question?

What a concept.
