“Here’s one for Hoboken411:The sidewalk outside of 813 Park.

On Tuesday I sprained my right ankle and tore up my left knee on this crack. It was dark 12:30am and I was taking the dog out. I stepped off the stoop and wound up on my ass in serious pain.

I wound up at St. Mary’s (411: HUMC for the newbies) for X-Rays to make sure it wasn’t a fracture. That plus there is no light in the vestibule of this building…

I know the building management company recently got my email and phone calls because today the vestibule and ground floor hall got new lights which is something I’d mentioned in my messages… now let’s see what they do about the sidewalk…”

    Here’s a reminder that Hoboken411 has a new “dangerous conditions” category, which was created and inspired by the Maxwell’s sidewalk skateboard ramp that recently injured a Hoboken resident.

    Whether it’s a giant pothole that can potential damage vehicles or cause a pedestrian “slip & fall,” to unruly garbage and disgusting food waste, this is the section you’ll find it.

    It doesn’t matter if you’ve tried to contact the owner, management company or even city hall about your complaints, you can anonymously send your photos and concerns to Hoboken411@gmail.com, and I’ll do my best to publicize for all to see.

    The more eyes and ears we have out there, the better chance we all have!

    Today’s Hoboken411 Legal Beagle segment deals with dangerous sidewalk conditions, and who’s responsibility it is to fix them. I’ve personally heard a few people having problems with this exact stretch on 11th Street.

    Maxwell’s doesn’t care about their sidewalk!

    “Who is responsible for ensuring that the sidewalks are maintained and don’t create any potentially unsafe conditions?

    Here is one particular area I’m concerned with. It’s near Maxwell’s on 11th Street. This overgrown tree has pushed the sidewalk concrete up to the point where it is unsafe. Furthermore, the street light nearby is not only one of the dimmer ones (not very bright), but the tree is so out of control, it blocks all the light.

    I recently tripped and fell on this late one night and badly injured my hand and chipped a tooth.

    Is the property owner responsible for maintaining it? Or the city?
    What about that overgrown tree? Who is supposed to manage that?

    Would a lawsuit be worthwhile?

    Hoboken legal beagleWell the Legal Beagle doesn’t specialize in personal injury (PI) cases, but this is the kind of case that makes a PI attorney drool!

    Your kind of case is called a slip and fall. Since this is a commercial building, not a one-three family building, the building owner or Maxwell’s itself (depending on the lease) are liable for such an obvious unsafe condition. Since the City of Hoboken may be responsible for this unsafe condition, not likely under NJ law, but if so, you would need to file a Title 59 Torts Claim Notice with the City of Hoboken with 90 days of the accident.

    But your job is not to worry about who is responsible but how to get the best possible lawyer. First, you did a great job with the pictures but the attorney you hire must immediately send out an expert to analyze the site (or is that sight, like what a horrible sight, hmm I wish I could cite some authority), and once at the location the expert will take measurements, note the general conditions, including the trees and lights, and then give a professional opinion that the area is unsafe.

    This section will be reserved EXCLUSIVELY for “citizen reported” breaking news events, and can be utilized to discuss any important stories or incidents BEFORE (or IF) they get published as an entry on Hoboken411. Please comment in this section only for those types of incidents.

    If the incident warrants it’s own story on 411, you can continue the conversation there (once I put it up). I’ll do my best to add the appropriate link(s) in the comment section here.

    Do’s and Dont’s

    Much like the Rant Corner and Rave Corner where pretty much anything goes, this section will be for general commuting and transportation issues in Hoboken.

    Got stuck on the PATH? Had a horrific cab ride? Ferry capsized? This is the spot.

    Anything from complaints, service interruptions, schedule changes, fare increases and other hot topics. So what is it today?

    borat-i-like-hoboken.jpgOK, a little short-sightedness caused the creation of a new posting called “Rant Corner”. That was done in order to give people an NC-17 place for them to express themselves, let some steam off, complain and be negative all they want. Technically, it was meant to be fun, and you’re not supposed to take it too seriously. It probably contains some bad language and more, and isn’t meant for everyone. The trash-talking section of 411, so to say.

    A reader suggested a “politically correct” posting so the shiny happy aspects of Hoboken can be discussed and we can all get teary-eyed and filled with love, joy and enlightenment.

    So what about Hoboken makes you want to keep living here?

    Despite our everyday complaints, I happen to love this City. From the awesome folks at Sasso’s and other family-run shops, to walking down the street and greeting the many people that I’ve come to know, to the four seasons, blooming trees and the nice cool breeze off the Hudson river, our City cannot be beat in my opinion. And much as the topic of City Hall has come up in recent months, I have to say even they’ve been doing a better job. While not as proactive as we’d like, they are certainly responding to some of the concerns of their citizens. I can see that they’re trying, regardless of the reasons why.

    We are a community, and maybe now is the time (at least after the election) that we (myself included) focus on what we deeply and sincerely like, and perhaps even take for granted.

    FYI, I will moderate the comments in this post and ensure they are “sanitized”. Seriously, try to work with me and see if we, as an online community, can keep this topic “fresh and fluffy” like a cute newborn kitten. Try not to take it personally if something you write is edited or removed entirely. Call this a “social experiment” if you must.

    Here’s a place you could you could talk about anything. Bicycles, obesity, laziness, or whatever doesn’t already have a topic for it.

    From time to time, some comments from other posts will be moved here as well, especially when they go so far off topic and it sort of becomes a new topic (like the Caddy on the sidewalk turning into bicycles and scooters.)

    All the commenters who dislike one another, try to keep your fights here. It’d be much easier for the crowd to follow along if they’re in one easy-to-swallow pill. Of course, there’s the alternative, which is getting along and meeting out for a drink. But how ridiculous is that?
