Can you beat a Hoboken parking ticket?

1/5/2010:

Let’s welcome new Hoboken resident (and Hoboken411 reader) Brian – and give him some advice on the infamous Hoboken “ambiguous parking laws!”

Hoboken Parking summonses make no sense!

“I recently moved to Hoboken a few months ago and have since discovered your site, very good and a great resource for the community, thank you!

I received one of the infamous parking tickets you have been debating about a few weeks ago. I was cited for parking within 25 ft of a crosswalk. I was not in the crosswalk, I was close, but there was no yellow on the curb where I parked.

Notice that there is no yellow paint and the sign actually shows an arrow depicting that you can park on either side of it. The summons that I got is described as parking “25 feet within Crosswalk”. I took out my measuring tape tonight and the sign ends up being exactly 25 feet from the crosswalk. I did not know that this was a law in NJ. I am sure it is a law, however, the sign is very misleading. It should have an arrow pointing only west or away from the crosswalk. That, along with no yellow paint, a Jeep parked on the east side of the sign and driving around for 20 minutes looking for a spot led to me decide to park there. I wasn’t sure if I would fit without being in the crosswalk, but I have a small car, and did end up fitting without obstructing the walkway. To add to my frustration, I feel that I was selectively ticketed as the Jeep that was also parked within 25′ of the crosswalk did not get a ticket.

I was wondering if you had heard of anyone that was able to fight these tickets and win?”

What advice can YOU give Brian?

Parking ticket DISMISSED.

Thank you to everyone that left constructive advice on this topic. As I said, I find this site to be a great resource to the community. I will forgo making assumptions towards others on this site as they have done towards me. I do not look to this site for that purpose.

The bottom line is that Hoboken has a parking problem, now what are we going to do about it?

Congratulations. You may have wasted 4+ hours of your time, but at least you prevailed.

How did you get the ticket dismissed? I am going to court this week to fight the same violation. Did you bring your pictures?

your right, the p.o. just didnt like the way i looked, and let me have it,after all, police dont lie,but aparently,i do.who cares about ice on the road.thats why so many parked cars are hit by nj transit buses on days like that.ive never been guilty of hiting anything when at work,or even in my car.yet ive got police at my job for no reason.my lic id was given at the scene, and i was told he was gonna calm the other p.o. down because he was just angry to be out in the ice, cold and snow directing traffic.in this country you are innocent till proven guilty.i hear from others that hoboken is a small town and no one is gonna believe me.there is snow and ice under the large vehicle im driving.the p.o decides to take advantage of me,try to provoke me and summons me not once but 3 times.if he told me turn left and i went right or backwards, that would be disobeying.but i was unable to move left.so i explained and was instructed by him to stay there.anything illegal about that?summons says ice/heavy/snow,proves im stuck.

Now it’s about the way you look. Please, I think you are looking for excuses. If your claim is that you were stuck how did the supervisior move the bus?

3 things here

1. Stop defending yourself, nobody cares.
2. Please proof read your posts, It is hard to read.
3. Stop blocking Broadway @ 34th St with your damn tour buses. I am delayed in going to Queens every day because you suck at driving.

first, i did what i was told, but there was ice on the road that morning.i made several turns before getting to that point, and had almost gone offroad at 16st.keep your wheels straight and you can stop, turn your wheels uhoh.the p.o that first took my lic id,told me he was witness, and was gonna try to calm the other p.o. down.there was ice on the road.a large vehicle is not like a car, once you lose control, your liable to be involved in an accident, thats the last thing i want.i complied by giving my lic id to th p.o.in the police car.i recognized him standing on park&16 earlier.after i complied with the p.o. at the scene, there is no reason for the first officer to show up at my job with another cop that wasnt even there,to harrass me in front of my boss, possibly lose my job.this is called stalking, whether your police or not.maybe sounds like a tall tale to you intill it happens to you.if i lose my job,i would do every thing in my power to sue the p.o. civily and the hoboken police.contact the media and, lawyer.

I am pretty sure police officers no that big vehicles are different from cars. Ice is dangerous regarless of the size vehicle you are driving. If you did what you were told by the officer there would have been no need for him to go to your job. If you were involved in a hit and run would you want the officer to not follow up with the person that hit you? I am pretty sure the officer was just doing his job and not”stalking” you. Poor choice of words. You should look that one up in the dictionary along with how to spell a few other words and use punctuation. Anyway if you lose your job you have no one else to blame but yourself. You did not comply with the officers directions. I would suggest instead of spending your money on getting a lawyer and the media you save it and look for another job that does not involve a commericial license. Your making a federal case out of a wrong you committed. If an officer stood on a corner and was not directing traffic during a snow storm you would have something to say about them not doing their job. Your just bitter. Angry You said “You should look that one up in the dictionary along with how to spell a few other words and use punctuation” But you spell know as no? Before you lecture others on spelling, learn to spell yourself. I am not defending the bigredboy but cmon? If you take the time to go to court you will always win or at least have the fine reduced. Take a pic of where you were parked. The prosecutor will try to gt you to reduce it or say that you need to come back again for “trial.” Its a terrible racket because most people don’t want to be bothered and just end up paying the fine. If you have the time fight it. You can also call and request court at night so you dont have to miss work.
