Dangerous condition: 813 Park sidewalk

Do you know the management company at 813 Park Avenue?
Well one Hoboken411 reader suffered some injuries on their crumbling sidewalk this week!
Cracked sidewalk is a sprain in the…
“Here’s one for Hoboken411:The sidewalk outside of 813 Park.
On Tuesday I sprained my right ankle and tore up my left knee on this crack. It was dark 12:30am and I was taking the dog out. I stepped off the stoop and wound up on my ass in serious pain.
I wound up at St. Mary’s (411: HUMC for the newbies) for X-Rays to make sure it wasn’t a fracture. That plus there is no light in the vestibule of this building…
I know the building management company recently got my email and phone calls because today the vestibule and ground floor hall got new lights which is something I’d mentioned in my messages… now let’s see what they do about the sidewalk…”

No, DietCokeGal does NOT sound cool. DCG is a LIAR!! I retract my former retraction of my original post. DCG claims in post #11:

That is BULLSHIT. After thinking for a bit that I don’t recall seeing a moving van on sunday, I rechecked some older threads. It seems DCG has been living here MUCH longer than she claims. See posts #76-78 on the Reader Mail: Poopy Cats thread:

Two choices:
Sue the person you were visiting;
Sue yourself as a resident/owner.
If that “crack” is so dangerous then Hoboken is a war zone.
BTW, who do you think lawsuit “Lady” will be voting for President this November?

Thank you bmoc and Katie. I do not appreciate people trying to lie to us 411 posters, and in my case 1/2 lurker, 1/2 poster. There was clearly no need for the lie. Just take your lumps and be done with it.
I still stand in awe of your sarcasm and wit though Katie!

This does not appear to be anything close to an unsafe condition. There are sidewalks that are in much worse shape.

But back to the sidewalk (no pun intended). I’ve always understood that the sidewalk in front of a building was the responsibility of the owner(s) of the property. In fact I lived in a condo building where we once got notice regarding the sidewalk and needed repair. If it snows the owner(s) is responsible for clearing the snow to the curb, for example. Certainly in this case the onus falls on the owners of the building, no (in this case the condo owners)? You never see the City correcting cracks in the sidewalk in front of private buildings, homes because I don’t think they have to. Even on Washington Street you sometimes see store owners fixing cracks in front of their stores. I’m not litigating here, just figured someone with “sidewalk expertise” will post.

DietCokeGal… you are strangely silent all of a sudden. Care to comment on your falsehoods?

Nope. I fell on a crack outside my new building and sprained my ankle. I haven’t been reading this thread and have nothing more to say on it. The only reason I’m writing this now is because I saw the recent comment on the left side of the home page.
What would be the point? You guys already have your minds made up that I’m a liar. I have no desire to continue this and feel no need to defend myself.
I know what the truth is and I know what happened.

Would you like to explain why you claimed to move in on Sunday, and fell on monday? You obviously have lived there MUCH longer than that, as evidenced in post #21?

8thStGuy…such a scooby doo you are!!! Okay since my kids are asleep and I can see what has your boxers in a twist I’ll explain but read slowly and take it all in because I’m only doing this ONE TIME.
We moved from one apartment on this block to another apartment on the SAME BLOCK.
We moved in Sunday and I fell on Monday. Those are the facts. What you DON’T have are the facts behind the fact. My youngest son is on the Autism Spectrum and he does not do well with change. The smallest switch in his routine or his day to day sends him over the edge and it’s ugly. Throwing, hitting, biting, kicking, head banging, running at walls, trying to claw me to ribbons. There is no calming him and no soothing him. It’s stressful for him, for my older son, for my husband and for me.
To keep him calm and relaxed and make the move go as smooth as we could I kept my two sons at the older apartment. I kept the computers and the cable on so we could watch TV and videos online.
I waited till he fell asleep at around 9:00 and carried him to the new apartment. I came to the new building using the left side of the stairs (my old apartment was closer to 8th than to 9th) and never saw the right side and never thought to look either.
I didn’t leave the house at all on Monday because I was unpacking, waiting for Cablevision and trying to get the kids used to the new place.
The first time I walked out was on Monday night at around 12:30 to take the dog for a pee. That’s when I fell.
I’m just really unclear as to what you all think I have to gain by making up such a story. I’m not looking for cash or a quick payout. The building said they are going to repair the crack as I’ve asked, end of story. That’s it. That’s all I wanted.
I’m not even asking them for my $50 co-pay.
Just want the sidewalk fixed. It’s getting done and I’m happy.
If you want to pursue this further let’s take it to email and I’d be more than happy to show you the photos of my ankle, knee and the discharge papers from the hospital.(I photo document EVERYTHING so the pictures were for my own scrapbook and not for anything else)
I’m not sure why I’d have to do this though. I really dislike having to defend myself in this manner. This feels like a witchhunt with you guys dragging up posts I’ve made in the past so you can jab your righteous fingers in the air and shout “AH HA! SHE’S A LIAR!!!”
I have zero reason to lie about this. I have much much better things to do with my time.
I fell, sprained my ankle and 411 asked for dangerous conditions. I send this to him. To me it was dangerous. That’s it. End of story.

I wanted you to see why we moved in to our new place in the fashion we did.
See what I deal with EVERY SINGLE DAY. See what happens when I try to take the dog out for a walk or go and do laundry.
THIS IS NOT MY SON but the tantrums are almost identical.

See why I have much much bigger things in my life than wasting anyone’s time making up stories about injuries.
Trust me. My life is complicated enough without needing to try to pull the wool over your eyes on here.

DCG,
I thought I remembered a post about you moving before this, but didn’t have time to look for it. Don’t bother explaining yourself. There is no pleasing everyone.
How are your kids doing with the new place?

Journey,
my oldest is fine. He’s an amazing kiddo who adjusts to ANYTHING.
My little guy is doing well but still freaks out and throws a tantrum if I leave the apartment without him even for a second.
He will understand in time. We just take everything day by day and moment by moment.
No posts about my moving as we were at our old apartment for almost 3 years.
8thStreetGuy are you done with this now? Can we all move on please?
Since you seem to live on my block stop by sometime and I’ll make you cookies. I’m not this horrible monster you seem to think I am…

DCG i’d like to take you out for a drink or two “milk or diet coke” of course.

I’m leaving this morning for a week at our house in the Berkshires with the kids so my lack of posts will be because I don’t have any internet access and not because I’m ignoring, avoiding or doing that 1/2 lurking thing I do…
