Free for the taking?

I tend to have faith that if piece of property like this says “Belongs to…” on it, that most individuals would leave it alone. But would it be considered a crime if taken?

One Hoboken411 reader wonders the same thing about this setup at Church Square Park:

Is this abandoned property?

“I took this picture a week ago; the signs say the enclosure belongs to the Hoboken Children’s Academy and include the center’s website.

At the time, I wondered whether it would be stealing if someone were to come along and take a sheet or a few sections of fence and bring them home. Could it be considered abandoned property?

It would have been funny if whoever left it there came back and found people sleeping in it. After all, the location is public property.”

Yeah, not the most compelling debate in the world, but it is kind of rude for them to hog the little open space we have here in Hoboken. This is along the lines of standing in a parking spot while your friend drives around!

I’d suggest the Children’s Academy either take it with them, or fold it up the next time. Either that, or not be upset if someone moves it for them.

I walk my dog through there most mornings around 7:30 and most evenings around 6 and have never seen that enclosure up.[/quote]

From the picture I can’t tell if it is cloth or some type of ground cloth with PVC coating on it. On my own personal property a few years ago a tent turned the grass brown in the time it took to have a long phone call. (I had cleaned the tent and was airing it out before packing it up, when I got a call.) It only took about 2 hours.

Would you leave your ipod or stereo out on the beach or at park while you were gone for hours? I personally would not mess with it, but there are dishonest folk out there.

they remove that at the end of each day, don’t they? Or is it a “summer fixture”?
